href=\"https:\/\/thecpra.org\/\" target=\"_blank\" rel=\"noopener\">California Privacy Rights Act (CPRA)<\/a>\u00a0amends and expands on the California Consumer Privacy Act (CCPA). CPRA went into effect on Jan 1, 2023. CCPA was amended to protect the personal data of California employees (B2E) and business-to-business (B2B) contacts and requires all organizations collecting California resident data to apply more extensive protections, such as privacy risk assessments, data minimization and retention policies.The CPRA now focuses data rights on b2b relationships and employees \u2013 from transparent data disclosure to more vigorous enforcement and higher awareness of privacy risks related to data collection and processing \u2014 and accounting for any data tied to California employees, businesses, and residents.<\/p><p><b>Who does the California Privacy Rights Act protect?<br \/><\/b>Any individual who is a California resident employee and a service provider\/vendor, contractor, consultant, applicant, freelancer, and remote worker can reasonably be identified.<\/p><h5><b>Employee &amp; B2B Data Rights:<\/b><\/h5><ul><li><strong>Right to know:<\/strong>\u00a0Employees, contractors, and service providers have the right to know what data is being collected and managed with the right to access copies of \u201cspecific pieces of personal information.\u201d<\/li><li><strong>Right to access:<\/strong>\u00a0Similar to consumers, employees will be able to submit a data subject access request (DSAR) to their employer for access to their information, with some exceptions.<\/li><li><strong>Right to use and disclose:<\/strong>\u00a0The right to request that a business limit or stop the use and disclosure of sensitive personal information.<\/li><li><strong>Right to correct:<\/strong>\u00a0The right to request that the business correct inaccurate information.<\/li><li><strong>Right to opt-out:<\/strong>\u00a0The right to opt-out of having personal information sold or shared.<\/li><li><strong>Right to Leniency:<\/strong>\u00a0The right to not be retaliated against for exercising any data rights.<\/li><\/ul><h5><b>Lightspeed Systems has the following procedures in place to ensure CCPA &amp; CPRA compliance:<\/b><\/h5><ul><li><strong>Data Subject Access Requests: Data subjects may exercise their rights by emailing our Privacy Team (<\/strong><a href=\"mailto:privacy@lightspeedsystems.com\">privacy@lightspeedsystems.com<\/a><strong>)<\/strong><\/li><li><strong>Data Mapping: Mapping, inventory and classification of all data<\/strong><\/li><li><strong>Data Minimization:<\/strong>\u00a0We only process data which is adequate, relevant, and limited to what is necessary to the purposes of the data being used.<\/li><li><strong>Data Retention Policies:<\/strong>\u00a0We have implemented Data Retention Policies across all our products and processes. It applies when personal data is processed in the EU and UK or when goods\/services are offered to EU and UK residents.<\/p><h3>How GDPR applies to Lightspeed<\/h3><ul><li><strong>Primary role:<\/strong> For products delivered to schools and districts, Lightspeed Systems acts as a \u201cData Processor\u201d\u2014processing personal data only on the \u201cData Controller\u2019s\u201d (the School\u2019s) documented instructions.<\/li><li><strong>Children\u2019s data:<\/strong> Because our customers are education institutions, we design our services to respect heightened expectations for minors\u2019 data and follow the Data Controller\u2019s chosen lawful basis (e.g., legitimate interests, or consent managed by the institution).<\/li><\/ul><h3>Our GDPR Program:<\/h3><ul><li><strong>Lawful, Fair, Transparent Processing<\/strong><ul><li>We process personal data lawfully and fairly, with clear purpose statements in customer contracts and product documentation.<\/li><li>Transparency: Controllers receive information, detailed in our Privacy Policy and Data Processing Agreements, describing categories of data, purposes, recipients (including sub-processors), and retention.<\/li><\/ul><\/li><li><strong>Roles &amp; Responsibilities<\/strong><ul><li>Processor obligations: We follow the controller\u2019s instructions, ensure confidentiality, assist with data subject requests, support DPIAs, and implement appropriate security.<\/li><li>Data Processing Agreement (DPA): Our DPA (including EU SCCs and UK IDTA) governs processing, security, breach support, audits, and sub-processors.
