Algemene verordening gegevensbescherming (AVG)
De Algemene verordening gegevensbescherming (AVG) sets rules for collecting, using, storing, and transferring personal data of individuals in the European Union and, via the UK GDPR, in the United Kingdom). It applies when personal data is processed in the EU and UK or when goods/services are offered to EU and UK residents.
How GDPR applies to Lightspeed
- Primary role: For products delivered to schools and districts, Lightspeed Systems acts as a “Data Processor”—processing personal data only on the “Data Controller’s” (the School’s) documented instructions.
- Children’s data: Because our customers are education institutions, we design our services to respect heightened expectations for minors’ data and follow the Data Controller’s chosen lawful basis (e.g., legitimate interests, or consent managed by the institution).
Our GDPR Program:
- Lawful, Fair, Transparent Processing
- We process personal data lawfully and fairly, with clear purpose statements in customer contracts and product documentation.
- Transparency: Controllers receive information, detailed in our Privacy Policy and Data Processing Agreements, describing categories of data, purposes, recipients (including sub-processors), and retention.
- Roles & Responsibilities
- Processor obligations: We follow the controller’s instructions, ensure confidentiality, assist with data subject requests, support DPIAs, and implement appropriate security.
- Data Processing Agreement (DPA): Our DPA (including EU SCCs and UK IDTA) governs processing, security, breach support, audits, and sub-processors. Requests to execute the DPA can be made by emailing [email protected]
- Data Minimization & Purpose Limitation
- Minimization: We collect and process only what is necessary to deliver and secure the service.
- Strict purpose use: No use for advertising or unrelated profiling; no sale of personal data.
- Data Mapping & Classification
- We maintain a living data inventory and classification linked to systems, purposes, storage locations, and legal bases.
- Records of Processing (Art. 30 “ROPA”): We keep a ROPA for both processor and limited controller contexts, including categories of data subjects/data, recipients, retention, and security measures.
- Data Retention & Disposal
- We retain personal data only as long as needed to meet contractual and legal obligations, then securely delete or anonymize.
- Controller verified data deletion requests are fulfilled within the stipulated timelines, as detailed in executed DPAs.
- Security of Processing
- Organizational & technical controls: role-based access control, MFA, least privilege, logging and monitoring, vulnerability management, encryption in transit (TLS) and at rest (AES), and secure SDLC with change control.
- Vendor security risk assessments, contractual security requirements, and periodic reviews of sub-processors.
- Privacy by Design & by Default
- We integrate privacy into product design—default-off or scoped data features, masking where feasible, and configuration options that let controllers tailor data collection to their needs.
- DPIAs, PIAs & AIAs
- We conduct Privacy Impact Assessments, Data Protection Impact Assessments and AI Impact Assessments for new or materially changed features that may pose elevated risk (e.g., content analysis, monitoring features).
- We assist controllers in their DPIAs with product information, safeguards, and risk mitigations.
- Data Subject Rights Support
- We assist controllers in fulfilling EU/UK data subject requests within statutory timelines:
- Access, Rectification, Erasure, Restriction
- Portability (where applicable)
- Objection to certain processing
- Consent withdrawal (where the controller uses consent as the basis)
- We assist controllers in fulfilling EU/UK data subject requests within statutory timelines:
- International Transfers
- Our Data Processing Agreement includes EU Standard Contractual Clauses and the UK International Data Transfer Agreement for transfers outside the EU/UK.
- Lightspeed Systems is also certified under the EU-US + UK Extension Data Privacy Framework
- Incident & Breach Management
- If a security incident affecting personal data occurs, we notify the controller without undue delay, provide incident details and remediation information, and cooperate so controllers can meet any supervisory authority and data subject notifications (e.g., the 72-hour rule for controllers).
- Sub-processors & Vendor Governance
- We maintain and share a current sub-processor list; and require written authorization, flow-down obligations, security controls, confidentiality, and deletion at end of service.
- Training, Governance, and Accountability
- Privacy & security training for relevant personnel, recurring awareness programs, and documented policies/standards.
- Internal audits and controls testing to evidence compliance.
